1. The agreement
Woosh is a voice, chat, and screen sharing app. These Terms are the agreement between you and Woosh AS ("we", "us"). They cover the app, the website, and everything in them, which we call the "Service".
By making an account, continuing as a guest, or using Woosh at all, you accept these Terms and the Privacy Policy. If you don't accept them, don't use Woosh.
Woosh is free to use. Features can change or be discontinued.
2. Who can use Woosh
You need to be 13 or older. Some EEA countries set a higher digital consent age, up to 16 under GDPR Article 8. If yours does, that age applies to you unless you have a parent's or guardian's permission. Guest accounts follow the same rule.
3. Your account
What happens on your account is your responsibility. Keep your password to yourself, and email contact@woosh.no if you think someone else has got in. We aren't liable for what follows if your credentials aren't kept safe.
You can delete your account whenever you want, from Settings in the app. Delete account explains exactly what goes and what stays.
4. Rules
Don't use Woosh to:
- Break the law, whether Norwegian, EU, or the law where you live
- Share child sexual abuse material or terrorist content, or incite violence or hatred against a protected group
- Harass, threaten, defame, dox, or impersonate anyone
- Send spam, malware, or phishing links
- Break into accounts, servers, or our infrastructure, or scrape or reverse engineer the Service
- Interfere with how the Service runs, or with its security
- Infringe anyone else's copyright or other intellectual property rights
If you break these rules we can remove the content, or limit, suspend, or close the account.
5. Reporting content, and how we respond
Anyone can report illegal content, with or without an account. Use the notice and action form. Copyright holders and other rightsholders use the same form.
We assess every properly completed report promptly, objectively, and without arbitrary decisions, then tell both the person who reported it and the person affected what we decided and why. That is Articles 16 and 17 of the EU Digital Services Act.
When we act against content or an account, we say what we did, what it was based on, and how to challenge it. To challenge it, email contact@woosh.no and we aim to answer within 14 days. If we can't settle it between us, you can take it to a certified out of court dispute body under DSA Article 21, or to court.
For serious or repeated violations, or where the law requires it, we can suspend an account immediately and without notice. You can still appeal.
6. Your content
Your messages, images, and streams stay yours. You give us permission to host, store, copy, transmit, and display them, worldwide and royalty free, only to run the Service and get your content to the people you sent it to. That permission ends when the content is deleted, apart from backup copies that age out as described in the Privacy Policy, and anything the law requires us to keep.
You're responsible for what you post. We don't check content before it goes out, but we can remove anything that breaks these Terms or the law.
7. Privacy, and the services we rely on
How we handle your data is set out in the Privacy Policy, which forms part of these Terms. It also lists the providers we use to run Woosh: hosting, push notifications, and GIF search. Their own terms cover their part, and we aren't responsible for what they do.
8. What we don't promise
As far as the law allows, Woosh is provided "as is" and "as available", with no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, timely, error free, or free of anything harmful.
None of this takes away consumer rights you can't waive where you live.
9. Liability
As far as the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, profit, or goodwill. Our total liability under these Terms is capped at EUR 100.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited under the consumer law where you live.
10. Ending it
You can stop using Woosh and delete your account at any time. We can suspend or close your access under section 5. Sections 6, 7, 8, 9 and 12 carry on applying afterwards.
11. Changes to these Terms
We can change these Terms. If a change matters, we'll announce it in the app or by email at least 14 days before it takes effect, and update the date and version at the top of this page. If you don't agree with a change, delete your account before it takes effect. Using Woosh after that means you accept it.
12. Law and disputes
Norwegian law applies, minus its conflict of laws rules. Disputes go to the Norwegian courts, with Oslo District Court as the agreed venue.
If you're a consumer in the EEA, this doesn't take away the mandatory protections of your own country's law, or your right to bring proceedings where you live. You can also take a complaint to the consumer dispute body where you live. In Norway that's the Norwegian Consumer Council, and for a cross-border complaint the European Consumer Centre in your country can help.
13. Official points of contact
Under Articles 11 and 12 of the Digital Services Act, our single point of contact is contact@woosh.no. That address serves Member State authorities, the European Commission, and the European Board for Digital Services, and it serves you as a user of the Service. Write in English or Norwegian, by whatever electronic means you like, and we reply by email.
14. Accessibility
We aim for WCAG 2.2 Level AA, in line with the European Accessibility Act. We're not there on every feature yet, since voice and screen share lean on platform capabilities that aren't always accessible, and we treat that as ongoing work. If something blocks you, or you need another way to use a feature, email contact@woosh.no and we'll reply within a month.
